These Terms & Conditions (“Terms”) apply when you access maggieandclaire.com, interact with our store or purchase from Maggie & Claire. By using the website or placing an order, you agree to these Terms together with the policies referenced below.
1. Our store
Maggie & Claire is the trading name used for this online store. References to “we”, “us” and “our” mean the merchant operating the Maggie & Claire storefront. You can contact us at info@maggieandclaire.com.
2. Using the website
You must use the website lawfully and must not interfere with its operation, security or other customers’ use of the site. You must not use the site for fraudulent activity, introduce malicious code, scrape or misuse personal information, or attempt unauthorised access.
3. Product information
We aim to present product descriptions, photographs, colours, sizes, measurements and prices accurately. Screen settings, lighting and normal manufacturing variations can cause minor differences in colour or appearance. Size and fit information is provided as a guide and can vary between styles.
Nothing in this section limits your rights if goods are materially different from their description or otherwise fail to meet a consumer guarantee that applies by law.
4. Availability
Products are offered subject to availability. We may limit quantities, correct errors or withdraw products from sale. If we cannot fulfil an order after payment, we will contact you and refund the affected item or order as appropriate.
As Maggie & Claire is currently holding a Final Retirement Clearance, some styles may sell out and may not be restocked.
5. Prices, taxes and total price
Prices on our Australian storefront are displayed in Australian dollars (AUD) unless clearly stated otherwise. We aim to display prices clearly and accurately. The amount shown at checkout will include applicable taxes and any unavoidable charges that we are required to include in the total price.
Prices and promotions may change from time to time. The price charged is the amount confirmed at checkout, subject to correction of an obvious error where permitted by law.
6. Promotions and bundle offers
Discount codes, automatic discounts, bundle offers and sale pricing are subject to the conditions displayed with the promotion. Unless stated otherwise, promotions cannot be combined. A promotion may be changed or ended without affecting an order that has already been accepted.
7. Orders and acceptance
When you place an order, you are making an offer to purchase the items in your cart. We may decline or cancel an order before fulfilment for legitimate reasons such as stock unavailability, an obvious pricing error, payment failure, suspected fraud or an inability to deliver to the address supplied. If we cancel a paid order, we will refund the affected amount.
Please review your order details carefully before checkout. If you need to change or cancel an order, contact us as soon as possible. Once processing or dispatch has begun, changes or cancellation may no longer be possible.
8. Payments
Payments are handled through Shopify and/or authorised payment providers. The payment methods actually available to you are shown at checkout. Please see our Payment Policy for more information.
9. Fulfilment, shipping and delivery
Orders are processed and delivered in accordance with our Shipping & Delivery Policy. Some orders may be fulfilled directly by international fulfilment partners. This means a parcel may originate outside Australia even though you purchase from Maggie & Claire through our Australian storefront.
Delivery dates are estimates unless expressly stated to be guaranteed. Carrier, customs, weather, peak-period and other delays outside our reasonable control may affect delivery timing.
10. Returns, refunds and Australian consumer guarantees
Our voluntary change-of-mind returns are described in our Returns & Refunds Policy. That voluntary policy operates in addition to, and not instead of, statutory rights.
Where the Australian Consumer Law applies, our goods come with consumer guarantees that cannot be excluded. Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.
11. Intellectual property
Unless otherwise stated, the website design, branding, text, graphics, photographs, logos and other content made available by us are owned by or licensed to Maggie & Claire and are protected by applicable intellectual-property laws. You may use the site for personal shopping purposes but may not reproduce or commercially exploit our content without permission.
12. Reviews and customer content
If you voluntarily submit a review, testimonial, image or other content for publication, you confirm that you have the right to provide it and that it is not unlawful, misleading, defamatory or infringing. Where you give us permission to publish content, you allow us to display it in connection with our store and marketing, subject to applicable privacy and consumer laws.
13. Third-party services and links
Our website relies on third-party providers such as Shopify, payment processors, carriers, fulfilment providers, analytics providers and other technology services. Links to third-party websites are provided for convenience and are subject to those third parties’ own terms and policies.
14. Errors and corrections
Occasionally the website may contain a typographical error, incorrect price, stock error or other inaccuracy. We may correct errors and update information. If an error affects an order you have placed, we will handle the matter in accordance with applicable law and will not use this clause to take away a consumer right that cannot lawfully be excluded.
15. Liability
To the maximum extent permitted by law, we are not responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control. Nothing in these Terms excludes liability or remedies that cannot be excluded under applicable law, including the Australian Consumer Law where it applies.

Our handling of personal information is described in our Privacy Policy and Cookie Policy. Where we send commercial electronic messages, we aim to comply with applicable Australian spam laws and provide a clear way to unsubscribe from marketing.
17. Changes to these Terms
We may update these Terms from time to time. The version published when you place an order will apply to that order unless a change is required by law or is more favourable to you.
18. Governing law
These Terms are subject to the laws that apply to the relevant transaction. Nothing in these Terms is intended to prevent an Australian consumer from relying on mandatory rights or remedies available under Australian law.
